There are various forms of music usage on the Internet and via new media. Each of these has its own rates.

Permission required from Buma/Stemra and SENA

If you are offering music via Internet and other new media, you need permission from Buma/Stemra. You can get further information about this via our contact form. If you take the music from existing sound carriers such as CDs, then you also need permission from the record companies and performers. This is not something Buma/Stemra does. For this, please contact SENA, the Foundation for the Exploitation of Neighbouring Rights.

What do you pay for distributing music via the Internet?

Are visitors to your website able to download music, free of charge or otherwise? If so, the amount owed is 10% of the price that the consumers pay for the download (excluding sales tax (BTW)). The minimum amount is € 0.06 per track downloaded and € 0.0375 per track streamed. The minimum amount is € 0.90 per album downloaded and € 0.57 per album streamed. You need permission from the copyright owner to use music on the Internet. Where music authors have transferred their rights to Buma/Stemra, we can give that permission. It is conditional on you sending us regular declarations (monthly or quarterly) that include details of the works presented, the copyright holders of those works, the origin of the recording and the performer(s) and producer of the recording, the number of times that the work was downloaded and the price per track.

What do you pay for radio or TV programmes on the Internet?

There are two types of transmissions of radio and TV programmes over the Internet. Passing on existing radio and TV transmissions over the Internet is known as simulcasting. Permission from the copyright holder is needed for this. Many broadcasters have made arrangements with Buma/Stemra for this.

Simulcasting

Permission from the copyright holder is needed for producing radio and TV programmes and transmitting them via the airwaves, satellites or a cable channel. Many local, regional, national and international broadcasters (both public and commercial) have therefore made copyright agreements with Buma/Stemra. These are included in the arrangements that the broadcasters make for their normal transmissions.

Webcasting

Permission from the copyright holder is also required for webcasting. Are these archived transmissions that can be viewed and listened to on request? Additional agreements can be made for this.

Copyright permission is needed from Buma/Stemra for webcasting. We impose certain conditions on granting that permission. We will ask you for regular declarations (monthly or quarterly) of the works transmitted, the copyright holders of those works, the origin of the recording and the performer(s) and producer of the recording.

The rate for webcasting is 13% of the turnover achieved with the website, with a monthly minimum amount of € 65 per channel for commercial websites and € 26 per channel for private individuals.

What do you pay for background music on your website?

If you use background music on your website, then you need permission from the copyright holder. The remunerations payable for background music are given in the table below. The rates are applicable per site per month (excluding sales tax (BTW)):

What do you pay for commercials on the Internet?

There are separate arrangements that apply to producing and placing commercials on a website.

The site owner has to pay a remuneration for placing (‘transmitting’) the commercial on a website, as per the rates for background music. First of all, the express permission of the music authors has to be obtained for the production of commercials.

What do you pay for using music via new media?

Copyright permission is required from Buma/Stemra for using music in ringtones, e cards, m cards, song cards and voicemail messages. We impose certain conditions on granting that permission. We will ask you for regular declarations (monthly or quarterly) of the works used, the copyright holders of those works, the origin of the recording and the performer(s) and producer of the recording, the number of times that the work was downloaded and the price per track or download. The rate is 12% of the price to the consumer (excluding 12% sales tax (BTW)) with a minimum of € 0.113 per ringtone, e card, m card, song card or voicemail message distributed.
